Terms & Conditions

By booking with Terra Cultura Tours Ltd (“we”, “us”, “our”), whether directly through our website, a third-party platform, or in writing- you (the “customer” or “you”) confirm that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, and any other information provided to you in writing prior to the confirmation of your booking. Together, these documents form the entire agreement and constitute the legally binding contract between you and Terra Cultura Tours Ltd, a company registered in England and Wales under Company Number 17015632, with its registered office at 74 Kennington Road, London, SE11 6NL, United Kingdom.

Please read these Terms and Conditions carefully before making a reservation, as they set out your rights, responsibilities, and obligations and the conditions under which we operate.

Acceptance of Terms & Conditions

By making a booking with Terra Cultura Tours Ltd, the first person named on the booking (the “group leader”) confirms, represents, and warrants on behalf of all persons included in the booking that:

  1. They have read, understood, and agree to be bound by these Terms and Conditions on behalf of all members of the party, and have the authority to do so. 

  2. They consent to the collection, use, and processing of personal data in accordance with our Privacy Policy, and confirm they are authorised to provide personal information for all individuals named on the booking. This may include, where relevant, information relating to health conditions, disabilities, dietary requirements, and age.

  3. They are at least 18 years of age at the time of making the booking.

  4. All members of the party meet any applicable age requirements and are eligible to participate in the services booked (see section Children)

  5. They accept full financial responsibility for the booking. All persons named on the booking shall be jointly and severally liable for all obligations and payments arising under the booking. This means that Terra Cultura Tours Ltd may hold any one or more members of the party responsible for the full amount of any payments due or obligations under these Terms and Conditions.

Bookings 

All bookings must be made via our official website, authorised partners/agents, or affiliated booking platforms.Upon confirmation, a legally binding contract between you and Terra Cultura Tours Ltd is formed. We reserve the right, at our sole discretion, to refuse or decline any booking request. In such circumstances, any payment received will be refunded in full, and no contract will be deemed to have been formed.

A booking will only be confirmed once we have received the full payment or required deposit (where offered). Following confirmation, you will receive a confirmation email containing full details of your booking, including the itinerary and relevant travel information. It is your responsibility to review this documentation carefully and to notify us without undue delay of any errors, omissions, or discrepancies.

Amendments and Cancellations

If you wish to request any changes to your booking (including dates, services, or participant details) or to cancel your booking, you must do so in writing via email at bookings@terraculturatours.com. All such requests are subject to availability and cannot be guaranteed. We reserve the right to apply additional charges where applicable. Please refer to our Cancellation and Modification Policy.

Payment Security and Verification

We reserve the right to carry out reasonable verification checks on payments and booking details to prevent fraud or unauthorised transactions. This may include requesting additional identification or payment confirmation. Failure to provide requested information within a reasonable timeframe may result in cancellation of the booking and refund of any payments received.

Pricing and Payment (Small Groups and Private Tours)

Pricing

  1. All prices displayed on our website are quoted in GPB (£), unless otherwise displayed. Prices are subject to change at any time prior to booking confirmation and will not affect bookings that have already been confirmed.

  2. Prices include only those services expressly stated in the relevant tour description. Unless explicitly specified, the following are not included:

    • Transport to and from the meeting point

    • Food and beverages

    • Personal expenses

    • Optional extras (including, but not limited to, private transfers or additional services) may be available at an additional cost and must be requested in writing at the time of booking via email at bookings@terraculturatours.com. All such requests are subject to availability and confirmation

  3. Prices may vary depending on factors including, but not limited to, group size, language requirements, operational costs, availability, and seasonal demand.

  4. While we make every effort to ensure that all pricing is accurate, we reserve the right to correct any typographical, administrative, or technical errors, as well as any omissions, at any time prior to booking confirmation. In the event of a pricing error, we will notify you as soon as reasonably practicable and provide you with the option to reconfirm your booking at the correct price or to cancel your booking and receive a full refund.

Payment Terms

  1. Payment must be made in full at the time of booking. 

  2. Accepted payment methods include major credit/debit cards, bank transfer, or secure online payment links. A booking will only be considered confirmed once payment has been successfully authorised and received in cleared funds. Any bank charges, currency conversion fees, or payment processing fees are the responsibility of the customer.

  3. We reserve the right to suspend or withdraw services, including participation in a tour, until full payment has been received. If payment is not received we reserve the right to treat the booking as cancelled by the customer. In such cases: cancellation charges may apply in accordance with our Cancellation Policy.

  4. Where a booking is made on behalf of multiple participants, the Group Leader and all members of the party shall be jointly and severally liable for all payments due.

  5. We reserve the right to take appropriate legal action to recover any outstanding amounts, including any reasonable administrative, legal, or recovery costs incurred, to the extent permitted by law.

Promotional Codes and Offers

Promotional codes must be applied at the time of booking and prior to payment and cannot be applied retrospectively. Promotional codes cannot be combined with any other offer and are non-transferable and have no cash value. Each code is valid only for the period specified and is subject to expiry, and may only be used once per booking. Terra Cultura Tours Ltd reserves the right to withdraw, amend, or cancel any promotion or promotional code at any time without prior notice.

Pricing and Payment (Bespoke and Multi-day Tours)

  1. Pricing for bespoke and multi-day tours is provided on a customised basis and is valid only for the period specified in the quotation. All prices are quoted in GPB (£), unless otherwise stated, and are subject to availability at the time of booking. Due to the tailored nature of these services, prices may vary depending on factors including, but not limited to, group size, accommodation standards, supplier availability, seasonal demand, and specific client requirements.

  2. A non-refundable deposit is required to confirm any bespoke or multi-day booking. The amount of the deposit will be specified at the time of quotation. A booking will only be considered confirmed once the required deposit has been received and a written confirmation has been issued by Terra Cultura Tours Ltd. The remaining balance must be paid by the deadline specified in your booking confirmation. Failure to pay the balance by the due date may result in cancellation of the booking, and the deposit and any additional payments made may be forfeited.

  3. Due to the nature of bespoke and multi-day tours, which often involve advance commitments to third-party suppliers (including, but not limited to, accommodation providers, transport operators, and guides), certain elements of the booking may be non-refundable once confirmed. These conditions will be communicated at the time of booking where applicable.

  4. All payments must be made in cleared funds via accepted payment methods, which include debit or credit card and bank transfer. Any bank charges, currency conversion fees, or payment processing costs are the responsibility of the customer.

  5. We reserve the right to adjust pricing prior to booking confirmation in the event of changes in supplier costs, taxes, exchange rates, or availability. In the event of a pricing adjustment after a quotation has been issued but before confirmation, you will be notified and given the option to proceed at the revised price or to decline without penalty.

  6. Where a booking is made on behalf of multiple participants, the lead booking name (the “Group Leader”) and all members of the party shall be jointly and severally liable for all payments due.

  7. Terra Cultura Tours Ltd reserves the right to suspend or withdraw services where payment obligations are not met. In the event of non-payment, we reserve the right to treat the booking as cancelled by the customer, and cancellation charges may apply in accordance with our Cancellation Policy. We further reserve the right to take appropriate legal action to recover any outstanding amounts, including any reasonable administrative, legal, or recovery costs incurred, to the extent permitted by law.

Cancellation Policy

All cancellation requests must be made in writing via email to bookings@terraculturatours.com. A cancellation will only be effective from the date on which we have received written notice. Canceling a booking may result in cancellation charges as set out in the cancellation policy below.

Small Group Tours 

For scheduled small-group tours, the following cancellation terms apply:

  1. Cancellations made more than 24 hours before the scheduled tour date will receive a full refund.

  2. Cancellations made less than 24 hours before the scheduled tour date are non-refundable and will incur a cancellation charge of 100% of the total booking cost.

Where a booking includes pre-purchased tickets, transport, or other third-party services, certain elements may be non-refundable from the time of booking. Any such costs will be deducted from any refund due.

Private Tours

For scheduled private tours, the following cancellation terms apply:

  1. Cancellations made more than 7 days before the scheduled tour date will receive a full refund.

  2. Cancellations made between 7 days and 3 days before the scheduled tour date will incur a charge of 50% of the total booking cost. 

  3. Cancellations made less than 3 days before the scheduled tour date are non-refundable and will incur a cancellation charge of 100% of the total booking cost.

Where a booking includes pre-purchased tickets, transport, or other third-party services, certain elements may be non-refundable from the time of booking. Any such costs will be deducted from any refund due.

Bespoke and Multi-Day Tours

For bespoke and multi-day tours, a non-refundable deposit is required to secure the booking and will be retained in all circumstances. The following cancellation terms apply:

  1. Cancellations made more than 30 days before the scheduled departure date will result in the loss of the deposit.

  2. Cancellations made between 30 days and 14 days before the scheduled departure date will incur a charge of 50% of the total booking cost. 

  3. Cancellations made less than 14 days before the scheduled departure date are non-refundable and will incur a cancellation charge of 100% of the total booking cost.

Certain elements of the booking, including accommodation, pre-booked tickets, transport, and other third-party arrangements are non-refundable from the time of confirmation and will be charged in full regardless of the cancellation date.

Modification and Rescheduling Policy 

All requests to modify or reschedule a booking must be made in writing via email to bookings@terraculturatours.com. Any request will only be effective from the date on which written notice is received. While Terra Cultura Tours Ltd will make reasonable efforts to accommodate changes, all modifications and rescheduling requests are subject to availability and cannot be guaranteed. Changes are not confirmed until we have issued written confirmation of the amended booking. Where amendments are possible, additional charges may apply, including administrative or operational fees and any increased costs imposed by third-party suppliers. Any difference in price between the original booking and the amended booking must be paid in full at the time of confirmation.

In certain circumstances, requested changes may be treated as a cancellation and rebooking, and the applicable cancellation terms set out in Clause 5 will apply.

Small Group Tours 

For scheduled small-group tours, the following terms apply:

  1. Requests made more than 24 hours before the scheduled tour date:

    You may reschedule your tour to an alternative date or time, subject to availability. Rescheduling is only possible for dates and time slots where Terra Cultura Tours Ltd has available spaces.

  2. Requests made less than 24 hours before the scheduled tour date, or failure to attend (no-show): 

It is no longer possible to reschedule the tour. You will need to make a new booking for the desired date or time. No refund will be provided for the original booking.

Where a booking includes pre-purchased tickets, transport, or other third-party services, certain elements may be non-exchangeable or subject to additional fees. Any such costs must be borne by the customer.

Private Tours

For scheduled private tours, the following terms apply:

  1. Requests made more than 7 days before the scheduled tour date:

    You may reschedule your tour to an alternative date or time, subject to availability. Rescheduling is only possible for dates and time slots where Terra Cultura Tours Ltd has available spaces.

  2. Requests made less than 3 days before the scheduled tour date, or failure to attend (no-show): 

    It is no longer possible to reschedule the tour. You will need to make a new booking for the desired date or time. No refund will be provided for the original booking.

Where a booking includes pre-purchased tickets, transport, or other third-party services, certain elements may be non-exchangeable or subject to additional fees. Any such costs must be borne by the customer.

Bespoke and Multi-Day Tours

Due to the customised nature of bespoke and multi-day tours, any requests for modification or rescheduling are subject to supplier availability and may incur additional costs. Changes requested after confirmation may not always be possible. Where changes can be accommodated, all additional costs, including those imposed by accommodation providers, transport operators, or other third-party suppliers, must be paid by the customer.

Cancellation or Changes by Terra Cultura Tours Ltd

Terra Cultura Tours Ltd reserves the right to cancel or make changes to any tour at its sole discretion, including changes to tour dates, itineraries, or participating guides, for operational, safety, or other legitimate reasons. Terra Cultura Tours Ltd shall not be liable for any additional costs incurred by the customer, including but not limited to travel, accommodation, or other related expenses.

If Terra Cultura Tours Ltd cancels a tour for reasons within our control, customers will be offered one of the following options:

  • Reschedule the tour to an alternative date, subject to availability;

  • Receive a travel credit to be used toward a future booking; or

  • Receive a full refund of all payments made for the affected tour.

Refunds will be processed using the original payment method. Terra Cultura Tours Ltd shall not be responsible for any additional costs incurred by the customer outside the tour booking itself, including but not limited to flights, accommodation, insurance, or other third-party travel arrangements.

Minimum Participant Requirement

Small group tours require a minimum number of participants to operate. For small group tours (excluding private and bespoke tours), a minimum of four paying participants is required for the tour to proceed.

If the minimum number of participants is not met, Terra Cultura Tours Ltd may:

  • Offer an alternative date or tour of comparable value, or

  • Provide a full refund of any payments made.

  • Single participants may book; however, if the tour cannot proceed due to insufficient participants, the booking will either be transferred to a suitable alternative tour or refunded in full.

Group Behaviour

By booking a tour, you agree to arrive on time at the designated meeting point. All participants are required to comply with the instructions of the tour leader, particularly regarding safety and conduct. You agree to respect local laws, sites and cultural heritage. The tour leader reserves the right to ask any participant to withdraw from the tour if their behaviour is deemed unsafe, disruptive, or potentially harmful to themselves or other members of the group. In such cases, no refund will be provided for the portion of the tour not attended.

Force Majeure

Terra Cultura Tours Ltd shall not be liable for any failure to perform its obligations under these Terms & Conditions where such failure is caused by events beyond our reasonable control (“Force Majeure”). This includes, but is not limited to:

  • War, acts of terrorism, or civil unrest

  • Natural disasters such as earthquakes, floods, or volcanic eruptions

  • Extreme weather conditions rendering travel unsafe

  • Strikes, transport disruptions, or other circumstances preventing the safe operation of the tour

  • Government restrictions or official closures of sites and attractions

If a tour is cancelled or disrupted due to Force Majeure, customers will not be held responsible for the cancellation. In such cases, Terra Cultura Tours Ltd may, at its discretion:

  • Reschedule the tour to an alternative date, subject to availability;

  • Receive a travel credit to be used toward a future booking; or

  • Receive a full refund of all payments made for the affected tour.

Refunds will be processed using the original payment method. Terra Cultura Tours Ltd shall not be responsible for any additional costs incurred by the customer outside the tour booking itself, including but not limited to flights, accommodation, insurance, or other third-party travel arrangements.

Refund Policy

All bookings with Terra Cultura Tours Ltd are subject to our Cancellation Policy, which sets out applicable deadlines, non-refundable elements, and administrative charges. Refunds will only be issued in accordance with these terms and, if approved, will be processed using the same payment method originally used for the booking.

No refunds will be provided for unused services, late arrivals, no-shows, or any portion of a tour once it has commenced. All tours are sold as complete packages; partial refunds for unused elements of a package are not available. Guests are responsible for arriving at the designated meeting point on time. Late arrivals may result in missed tours, and no refunds or rescheduling will be provided.

If your booking was made through a third-party agent or authorised booking partner, any cancellation or refund requests must be submitted to that agent. Terra Cultura Tours Ltd is not responsible for processing refunds for bookings made through third parties and cannot guarantee the timelines, policies, or outcomes applied by such agents. For services purchased separately from third-party suppliers, Terra Cultura Tours Ltd cannot issue refunds or prorate fees. We are not responsible for delays in the refund process caused by banks, payment providers, or third-party platforms.

Terra Cultura Tours Ltd reserves the right to refuse a refund where it reasonably believes the request falls outside the terms of this policy or the associated cancellation policy.

Third Party Suppliers

Some of the services that form part of your experience with Terra Cultura Tours Ltd are provided by independent suppliers. These suppliers operate under their own terms and conditions, and we act solely as organiser and intermediary. While we carefully select and recommend suppliers, Terra Cultura Tours Ltd is not liable for any acts, omissions, or failures of these third-party suppliers. By booking with us, you acknowledge that certain aspects of your tour may be subject to the suppliers’ own rules, policies, and procedures. We recommend that you familiarise yourself with these terms where applicable.

Health, Medical Conditions, and Special Requests

Fitness to Participate

You confirm that you voluntarily choose to participate in the tours and understand the nature of the activities involved. You must confirm that you are in suitable physical and mental condition to participate and that you do not suffer from any medical conditions, disability, or special requirements that may increase the risk of injury or adversely affect your ability to safely take part. You agree to inform us in writing at the time of booking of any relevant medical conditions, disability, or special requirements. Any changes occurring after booking must also be communicated promptly.

Information may be shared with suppliers as necessary to accommodate your needs. Acting reasonably, if we or our suppliers are unable to safely accommodate a participant, we may:

  1. Decline to confirm the booking, or

  2. Cancel the booking, applying relevant cancellation charges if full details were not provided initially.

  3. Assess your disclosed information to determine the suitability of tour arrangements. Guests remain responsible for exercising reasonable care, following instructions, and adhering to safety guidance provided by our team or suppliers.

Special Requests

All special requests must be communicated at the time of booking. Guests with dietary requirements, food intolerances, or allergies must notify us in writing at the time of booking. We will pass all such requests to relevant suppliers; however, we cannot guarantee that all dietary needs can be fully accommodated, and cross-contamination may occur. Guests are responsible for managing their own dietary requirements, including informing guides and suppliers on the day of the experience and taking appropriate precautions. 

Terra Cultura Tours Ltd shall not be liable for any reactions, illness, or issues arising from food or services provided by third parties.

Confirmation that a request has been noted on your booking or invoice does not constitute a guarantee. All requests are subject to availability, and any critical requirements must be confirmed in writing prior to travel.

Archaeological Sites & Inherent Risks

Terra Cultura Tours Ltd is not liable for injuries, losses, or damages. Many tours take place in historic or archaeological environments, such as Pompeii, which present inherent risks, including:

  1. Uneven surfaces, loose stones, and ancient pathways

  2. Limited shade, exposure to heat, or restricted access areas

  3. Limited modern safety infrastructure

By participating, guests acknowledge that:

  1. These environments cannot be made completely risk-free

  2. Participation is at your own risk, except where injury or loss is caused by our negligence

  3. You are responsible for following all instructions, wearing suitable footwear, and taking reasonable precautions

Some tours and activities involve inherent risks, including physical, archaeological, or outdoor environments (e.g., Pompeii, uneven surfaces, ancient structures). You may be required to sign a disclaimer before participating. By taking part, you acknowledge these risks and accept responsibility for exercising reasonable care.

Children

  1. All children under the age of 18 must be accompanied and supervised by a responsible adult at all times during the tour.

  2. Certain tours are specifically designed for families, while others may not be suitable for young children due to duration, terrain, or content. Minimum age requirements or restrictions may apply depending on the nature of the experience.

  3. Parents or guardians are fully responsible for ensuring that children are fit to participate and comply with all safety instructions. Terra Cultura Tours Ltd is not responsible for the actions of children or any consequences arising from those actions.

  4. Adults supervising children are liable for their safety, behaviour, and well-being throughout the tour.

Insurance

We strongly require that all guests obtain comprehensive travel insurance prior to their tour. Your policy should provide adequate cover for, at a minimum: a. Trip cancellation; b. Medical expenses; and c. Personal belongings

You must ensure that your insurance policy fully covers your individual requirements, including any pre-existing medical conditions, cancellation charges, medical treatment, and repatriation in the event of an accident or illness.

Please read your policy details carefully and carry a copy with you while travelling. It is your responsibility to ensure that the insurance you purchase is suitable and sufficient for your specific needs. If you choose to travel without adequate insurance cover, Terra Cultura Tours Ltd shall not be liable for any losses, costs, or claims that would otherwise have been covered by such insurance.

Liability

Terra Cultura Tours Ltd maintains appropriate public and professional liability insurance for the services we provide. Participation in all tours is voluntary and undertaken at your own risk. You are responsible for exercising reasonable care and following all safety instructions provided by our staff or representatives. By participating in our tours, you fully acknowledge and accept that our experiences involve inherent risks, including, but not limited to exposure to adverse weather conditions, food-related illness, risks of injury arising out of accidents, interactions with other participants, traffic, pedestrians, and other external factors, and in, rare cases, serious injuries or death. We act as a service provider and organiser and, to the fullest extent permitted by law, shall not be liable for:

  • Loss, theft, or damage to personal belongings;

  • Delays,  disruptions, or changes caused by circumstances outside our reasonable control;

  • Injuries, illness, or death sustained during a tour.

You are responsible for any damage or loss caused by you or any member of your party. Payment for such damage or loss (reasonably estimated if not precisely known) must be made promptly to the relevant supplier or to Terra Cultura Tours Ltd. Where the actual cost differs from the estimated amount, the balance shall be payable accordingly.

Limitation of Liability and Indemnity 

You agree to indemnify, defend, and hold harmless Terra Cultura Tours Ltd, its affiliated entities, and their respective directors, officers, employees (whether former or current), contractors, agents, insurers, and suppliers (together, the “Indemnified Parties”) from and against any and all claims, actions, liabilities, damages, losses, and expenses (including reasonable legal costs) arising out of or in connection with:

  • Your participation in any tours or services provided by Terra Cultura Tours Ltd;

  • Your use of our website or booking platforms;

  • Any information, content, or materials provided by you;

  • Any material submitted, posted, or transmitted through your booking or account;

  • Any breach of these Terms & Conditions by you or any member of your party;

  • Any negligent, unlawful, or wilfully improper act or omission by you or any member of your party.

This indemnity applies to claims relating to injury, death, or damage to property, to the fullest extent permitted by law, except where such claims arise directly from the negligence or wilful misconduct of Terra Cultura Tours Ltd.

Website, Cookies & Data Security

The Privacy Policy explains how Terra Cultura Tours Ltd collects, uses, maintains, and discloses information from users of our website, www.terraculturatours.com, and from customers booking our tours and services. We are committed to protecting your privacy and comply with the UK GDPR and the Data Protection Act 2018. Personal Data

  1. Personal data collected will be used solely to process and fulfil bookings, communicate important tour information, and provide related services.

  2. For group bookings, the Group Leader is responsible for obtaining consent from all members to share their personal data with Terra Cultura Tours Ltd.

  1. Our website uses cookies and similar tracking technologies to improve functionality, personalise your experience, and for analytics and marketing purposes.

Photography & Media Consent

Terra Cultura Tours Ltd may take photographs or video footage during tours for marketing and promotional purposes, which may include images of guests. By participating in a tour, you grant us a worldwide, royalty-free licence to use such images or videos in any media for marketing purposes. If you do not wish your image, or the image of any person for whom you are a parent or guardian, to be used, you must notify us in writing no later than the completion of your tour.

Website Disclaimer and Limitation of Liability

While Terra Cultura Tours Ltd uses reasonable efforts to ensure that the information provided on our website, brochures, and other promotional materials is accurate and up to date, we make no representations or warranties, express or implied, regarding the accuracy, completeness, or reliability of any content.

All content is provided on an “as is” and “as available basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

  • The website will be uninterrupted, secure, or error-free

  • Any defects will be corrected

  • The website or servers are free from viruses or other harmful components

Use of the website is at your own risk.

To the fullest extent permitted by law, Terra Cultura Tours Ltd shall not be liable for:

  • Any errors or omissions in website or brochure content

Intellectual Property

Complaints

In the unlikely event that you have a complaint or experience a problem during your tour, you must immediately inform our office at support@terraculturatours.com or contact your tour leader on-site. Our goal is to resolve all issues fairly and efficiently, and your feedback helps us maintain high standards of service.

  1. Complaints should be reported as soon as possible to allow us to investigate and resolve the matter promptly.

  2. Please provide detailed information, including your booking reference, the nature of the complaint, and any supporting evidence.

  3. We will acknowledge receipt of your complaint within 48 hours and aim to provide a full response or resolution within 14 days.

Jurisdiction and Governing Law

These Terms and Conditions and any agreement to which they apply are governed by the laws of England and Wales. Any dispute, claim, or other matter arising between Terra Cultura Tours Ltd and the customer in connection with your booking or contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.
